The basic requirements for land & condominium title transfer are as follows:
- Original Copy of deed or instrument (e.g. deed of sale or donation)
- Certified true copy of tax declaration
- Original owner’s duplicate copy of title
- BIR Certificate Authorizing Registration (CAR)
- Real property tax clearance
- Proof of payment of transfer tax
It takes around sixty (60) to ninety (90) working days to complete the whole process of transferring title from the registered owner to the new owner.
For land/condominium title transfer through sale or donation you need to pay the following:
- Capital Gain Tax/ Donor’s Tax – 6% of the the purchase price or zonal value of the property,, whichever is higher;
- Documentary Stamp Tax – 1.5% of the purchase price or zonal value of the property;
- Transfer Tax – 0.0075% to 1% of the value of the property as determined by the City or Municipality where the property is situated;
- Registration Fee – 0.0050% of the value of the property
You will need to settle the estate tax of the deceased registered owner of the property. You only have one (1) year from the death of the registered owner to pay the estate tax. Expect penalties, interest, and charges for late payment.
